لماذا أجيز الوضوء بمياه الحنفية المتغيرة بالمواد الكيميائية المطهرة؟ ما الأدلة الشرعية التي وقع الاعتماد عليها ؟ جزاكم الله خيرا

Why is it permissible to perform wudu with tap water that has changed due to purifying chemicals? What are the shari’ah proofs relied upon? May Allah reward you with goodness.

Answer:

الحمد لله، والصلاة والسلام على رسول الله، وعلى آله وصحبه، أما بعد:

All praise is due to Allah, and peace and blessings be upon the Messenger of Allah, his family, and his companions. To proceed:

فإن الماء المتغير بمادة لا تلازمه غالباً لا يصلح للوضوء ولا لغيره من الطهارة، كما هو مبين في الفتوى الأخرى هنا.

Indeed, water that has changed due to a substance that does not typically accompany it is not valid for wudu nor for other forms of purification (at-thaharah), as explained in the other fatwa here.

لكن بعض أهل العلم استثنى من ذلك تغير الماء غير البين بما يصلحه أو يصلح وعاءه، كالدباغ ونحوه فجعله من المعفوات للحاجة إليه.

However, some scholars excepted from this the unapparent change of water caused by something that improves it or improves its container, such as tanning (dibagh) and the like, thereby classifying it among the excused matters (al-ma‘fuwat) due to the need for it.

لذا فإننا نرى أن تغير الماء بالمواد الكيميائية التي تصلحه لا يسلب عنه الطهورية

Therefore, we view that the change in water due to chemicals that improve it does not strip away its purifying property (at-thahuriyah).
