Ruling on Purifying Oneself with Water Mixed with Soap

السؤال

Question:

ما حكم بقاء أثر لزوجة الصابون، أو الحبر على اليدين أثناء الوضوء؟ وهل هذا يبطل الوضوء؟ وهل اختلاط الماء المخصص للوضوء بالصابون، أو غيره يفسد الوضوء؟

What is the ruling on the remaining traces of soap sliminess or ink on the hands during wudu? Does this invalidate wudu? And does the mixing of the water designated for wudu with soap or anything else invalidate wudu?

الإجابــة

Answer:

الحمد لله، والصلاة والسلام على رسول الله، وعلى آله وصحبه، أما بعد:

All praise is due to Allah, and peace and blessings be upon the Messenger of Allah, his family, and his companions. To proceed:

فإن كان ما على اليد مما ذكر يحول دون وصول الماء إلى البشرة؛ لكونه ذا جِرم: فالواجب إزالته قبل الوضوء، فإن بقاءه يمنع صحة الطهارة.

If what is on the hand from what has been mentioned prevents water from reaching the skin because it has a physical layer (jirm), then it is obligatory to remove it before wudu, as its remaining prevents the validity of purification.

وأما إن كان لا جرم له: فإنه لا يحول دون وصول الماء إلى البشرة، ومن ثم لا يمنع صحة الطهارة، والظاهر في الأثر المذكور أنه لا يحول دون وصول الماء إلى البشرة، وانظر الفتوى الأخرى هنا

However, if it has no physical layer, then it does not prevent water from reaching the skin, and therefore does not prevent the validity of purification. It appears that the mentioned trace does not prevent water from reaching the skin. See the other fatwa here.

قال النووي في الروضة: فَإِنْ بَقِيَ لَوْنُ الْحِنَّاءِ، لَمْ يَضُرَّ، وَإِنْ كَانَ عَلَى الْعُضْوِ دُهْنٌ مَائِعٌ، فَجَرَى الْمَاءُ عَلَى الْعُضْوِ، وَلَمْ يَثْبُتْ، صَحَّ وضوؤه. انتهى.

An-Nawawi said in Ar-Raudhah: “If the color of henna remains, it does not harm. And if there is liquid oil on the limb, and water flows over the limb without staying fixed, his wudu is valid.” End of quote.

وأما اختلاط الماء بالصابون، أو غيره: فإن كان الماء متغيرًا بالصابون، بحيث يزول عنه اسم الماء المطلق لم يصح التطهر به.

As for the water mixing with soap or other substances: if the water is altered by the soap such that the name ‘absolute water’ (ma’ muthlaq) is stripped from it, then purification with it is not valid.

وإن كان غير متغير به، أو كان التغير يسيرًا: صحت الطهارة، وهذا قول كثير من العلماء، أو أكثرهم، وعند بعض أهل العلم أن تغير الماء بمخالطة طاهر له لا يمنع صحة التطهر به، ما لم يخرج عن اسم الماء، والأول أحوط،

But if it is not altered by it, or the alteration is slight, then the purification is valid. This is the view of many or most scholars. According to some people of knowledge, the alteration of water due to being mixed with a pure substance does not prevent the validity of purification with it, as long as it does not lose the name of water. The first view is more cautious.

قال الزركشي في شرح الخرقي: ما سقط في الماء مما ذكره من الباقلاء، والزعفران، والورد، والحمص، أو غيره من الطاهرات، كالعصفر، والملح الجبلي، وورق الشجر إذا وضع فيه قصدًا، ونحو ذلك، وكان الواقع يسيرًا، فلم يوجد للواقع في الماء طعم، ولا لون، ولا رائحة، حتى أنه بسبب ذلك يضاف الماء إليه، فيقال: ماء زعفران، ونحو ذلك، فهو باق على إطلاقه فيتوضأ به؛ لدخوله تحت قَوْله تَعَالَى:

Az-Zarkashi said in Syarh al-Kharqi: “Whatever falls into water among what has been mentioned of fava beans, saffron, roses, chickpeas, or other pure substances such as safflower, rock salt, and tree leaves when placed in it intentionally and the like, and the fallen amount is slight so that no taste, color, or odor is found for the fallen substance in the water—to the extent that because of it water is attributed to it, so it is said: ‘saffron water’ and the like—then it remains upon its absolute nature and wudu can be performed with it, because it falls under the saying of Allah Ta’ala:

{فَلَمْ تَجِدُوا مَاءً فَتَيَمَّمُوا} [النساء: ٤٣]

‘…and you find no water, then perform tayammum with clean earth’ (Surah an-Nisa verse 43)”

وقد ثبت أن النبي صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ اغتسل هو وزوجته من جفنة فيها أثر عجين.

And it has been established that the Prophet shallallahu ‘alaihi wa sallam and his wife performed ghusl from a vessel in which there were traces of dough.

ومفهوم كلام الخرقي أنه متى وجد للواقع لون، أو طعم، أو رائحة كثيرة، بحيث صار الماء يضاف إليه، زالت طهوريته، ومنع التوضؤ به، وهو إحدى الروايات، اختارها أكثر الأصحاب؛

The implication of al-Kharqi’s words is that whenever a color, taste, or abundant odor from the fallen substance is found, such that the water becomes attributed to it, its purifying property is stripped away, and performing wudu with it is prevented. This is one of the narrations, chosen by most of the companions of the madhhab;

(والرواية الثانية) وهي الأشهر نقلًا، وإليها ميل أبي محمد – هو باق على طهوريته؛ لأن (ماء) من قَوْله تَعَالَى: {فَلَمْ تَجِدُوا مَاءً} [النساء: ٤٣] نكرة في سياق النفي، فيشمل كل ماء، إلا ما خصه الدليل،

(The second narration) — which is the more famous in transmission, and towards which Abu Muhammad inclines — states that it remains upon its purifying property; because ‘water’ (ma’an) in the saying of Allah Ta’ala:

{فَلَمْ تَجِدُوا مَاءً فَتَيَمَّمُوا} [النساء: ٤٣]

‘…and you find no water, then perform tayammum with clean earth’ (Surah an-Nisa verse 43)”

is an indefinite noun in the context of negation, so it includes all water, except what has been specified by proof.

(والرواية الثالثة) أنه طهور بشرط أن لا يجد غيره، وحيث أثر التغيير فإنما هو إذا كان كثيرًا. انتهى.

(The third narration) states that it is purifying on the condition that he finds no other water, and where the alteration has an effect, it is only when it is abundant. End of quote.
