Question:

ماذا يفعل الحاج إذا خرجت منه ريح وهو متوجه إلى الطّواف أو عرفات ؟

What should a pilgrim do if he passes wind while on his way to Tawaf or Arafah?

الجواب

Answer:

الحمد لله والصلاة والسلام على رسول الله، وبعد:

Praise be to Allah, and peace and blessings be upon the Messenger of Allah. To proceed:

First:

ذهب جمهور العلماء إلى أن الطواف لا يصح من غير طهارة ، وقد سبق بيان اختلاف العلماء في ذلك في جواب السؤال الأخر هنا ،

The majority of scholars are of the view that Tawaf is not valid without ritual purity. The difference of opinion among scholars regarding this has already been explained in the answer to another question here,

• Is purity (wudu) required during Tawaf and Sa’i?

فمن انتقض وضوؤه وهو متوجه للطواف فإنه يذهب ويتوضأ ثم يشرع في طوافه . هذا هو الأولى والأحوط بلا شك .

Therefore, whoever loses his wudu while heading towards Tawaf should go and perform wudu, then begin his Tawaf. This is undoubtedly the most preferred and safest course of action.

Second:

أما الوقوف بعرفات فلا تشترط له الطهارة ، فلا حرج على الحاج أن يقف بعرفات وهو غير متوضئ ، ولا يلزمه الوضوء إلا عند إرادة الصلاة ، وقد اتفق العلماء على أنه يصح وقوف الحائض والجنب .

As for standing at Arafah, ritual purity is not a condition for it. Thus, there is no harm if a pilgrim stands at Arafah without wudu, and wudu is not obligatory upon him except when he intends to pray. Scholars have agreed that the standing of a menstruating woman or a person in a state of major impurity (junub) is valid.

قال النووي رحمه الله في “المجموع” (٨/١٤٠) : ” قال ابن المنذر : أجمع العلماء على أنه يصح وقوف غير الطاهر من الرجال والنساء كالجنب والحائض وغيرهما ” انتهى .

An-Nawawi (may Allah have mercy on him) said in Al-Majmu’ (8/140): “Ibn al-Mundhir said: The scholars unanimously agreed that the standing of an impure person—whether male or female, such as one in a state of junub, a menstruating woman, or others—is valid.” End quote.

غير أنه يستحب أن يقف طاهراً من الحدثين : الأكبر والأصغر ، لأنه سيذكر الله تعالى ، ويستحب الوضوء عند ذكر الله تعالى .

However, it is recommended to stand in a state of purity from both major and minor impurities, because one will be remembering Allah Almighty, and it is recommended to have wudu when remembering Allah Almighty.
