What is the Islamic ruling on wearing the niqab (face veil)?

Answer:
الحمد لله والصلاة والسلام على رسول الله .. وبعد:
Praise be to Allah, and peace and blessings be upon the Messenger of Allah. To proceed:
فقد اختلف العلماء في وجوب تغطية الوجه والكفين من المرأة أمام الأجانب .
The scholars have differed regarding the obligation of a woman covering her face and hands in front of non-mahram men.
فمذهب الإمام أحمد والصحيح من مذهب الشافعي أنه يجب على المرأة ستر وجهها وكفيها أمام الرجال الأجانب ، لأن الوجه والكفين عورة بالنسبة للنظر ،
According to the school of Imam Ahmad and the correct view in the Shafi’i school, it is obligatory for a woman to cover her face and hands in front of non-mahram men, because the face and hands are considered ‘awrah with respect to being looked at.
ومذهب أبي حنيفة ومالك أن تغطيتهما غير واجبة ، بل مستحبة ، لكن أفتى علماء الحنفية والمالكية منذ زمن بعيد أنه يجب عليها سترهما عند خوف الفتنة بها أو عليها. والمراد بالفتنة بها : أن تكون المرأة ذات جمال فائق ، والمراد بخوف الفتنة عليها أن يفسد الزمان، بكثرة الفساد وانتشار الفساق .
The view of Abu Hanifah and Malik is that covering them is not obligatory, but recommended (mustahabb). However, the scholars of the Hanafi and Maliki schools issued fatwas long ago that covering them becomes obligatory when there is fear of temptation (fitnah) through her or for her. “Fitnah through her” means that the woman possesses striking beauty, whereas “fear of fitnah for her” means that times have become corrupted through widespread evil and the prevalence of immoral people.
وعلى هذا يمكن أن يقال إن فقهاء المذاهب الأربعة متفقون على وجوب ستر وجه المرأة عند خوف الفتنة وفساد الزمن.
Based on this, it can be said that the jurists of the four schools of thought are in agreement on the obligation of covering a woman’s face when there is fear of fitnah and corruption in times.
وأما الأدلة على وجوب الستر من القرآن والسنة فكثيرة منها :
As for the evidences regarding the obligation of covering from the Qur’an and Sunnah, they are numerous, including:
1- قوله تعالى
1) The saying of Allah the Exalted:
( يا أيها النبي قل لأزواجك وبناتك ونساء المؤمنين يدنين عليهن من جلابيبهن ذلك أدنى أن يعرفن فلا يؤذين ) [الأحزاب:59] .
“O Prophet, tell your wives and your daughters and the women of the believers to bring down over themselves [part] of their outer garments. That is more suitable that they will be known and not be abused.” (Surah Al-Ahzab: 59).
وقد قرر أكثر المفسرين أن معنى الآية : الأمر بتغطية الوجه ، فإن الجلباب هو ما يوضع على الرأس ، فإذا اُدنِي ستر الوجه ، وقيل : الجلباب ما يستر جميع البدن ، وهو ما صححه الإمام القرطبي ، وأما قوله تعالى في سورة النور
Most commentators of the Qur’an have established that the meaning of this verse is the command to cover the face, because the jilbab is what is placed over the head, so when it is drawn down, it covers the face. It is also said that the jilbab is what covers the entire body, which is what Imam Al-Qurtubi affirmed to be correct. As for the saying of Allah the Exalted in Surah An-Nur:
( إلا ما ظهر منها )
“except that which appears thereof”,
فأظهر الأقوال في تفسيره : أن المراد ظاهر الثياب كما هو قول ابن مسعود رضي الله عنه ، أو ما ظهر منها بلا قصد كأن ينكشف شيء من جسدها بفعل ريح أو نحو ذلك . والزينة في لغة العرب ما تتزين به المرأة مما هو خارج عن أصل خلقتها كالحلي والثياب ، فتفسير الزينة ببعض بدن المرأة كالوجه والكفين خلاف الظاهر .
the most apparent of the opinions regarding its interpretation is that it refers to the outer garments, as is the view of Ibn Mas’ud (may Allah be pleased with him), or what appears unintentionally, such as something being exposed by the wind or similar factors. “Adornment” (zeenah) in the Arabic language refers to that which a woman uses to beautify herself outside her original body, such as jewelry and clothing; thus, interpreting adornment as parts of a woman’s body like the face and hands is contrary to the apparent meaning.
2- آية الحجاب وهي قوله تعالى
2) The verse of Hijab, which is the saying of Allah the Exalted:
( وإذا سألتموهن متاعاً فاسألوهن من وراء حجاب ذلكم أطهر لقلوبكم وقلوبهن ) [الأحزاب:53] .
“And when you ask [his wives] for something, ask them from behind a partition. That is purer for your hearts and their hearts.” (Surah Al-Ahzab: 53).
وهذه الطهارة ليست خاصة بأمهات المؤمنين ، بل يحتاج إليها عامة نساء المؤمنين ، بل سائر النساء أولى بالحكم من أمهات المؤمنين الطاهرات المبرءات.
This purity is not exclusive to the Mothers of the Believers; rather, all believing women are in need of it. In fact, all other women are even more in need of this ruling than the Mothers of the Believers, who were pure and innocent.
3- قوله تعالى
3) The saying of Allah the Exalted:
( وليضربن بخمرهن على جيوبهن ) [النور:31] .
“and to wrap [a portion of] their headcovers over their chests” (Surah An-Nur: 31).
وقد روى البخاري عن عائشة رضي الله عنها قالت ” لما أنزلت هذه الآية أخذن أزرهن. فشققنها من قبل الحواشي فاختمرن بها ” . قال الحافظ ابن حجر : ( فاختمرن ) أي غطين وجوههن.
Al-Bukhari narrated from Aisha (may Allah be pleased with her) that she said: “When this verse was revealed, they took their waist sheets, tore them at the edges, and covered themselves with them.” Al-Hafidh Ibn Hajar said: “(and covered themselves) means they covered their faces.”
4- قوله تعالى:
4) The saying of Allah the Exalted:
( والقواعد من النساء اللاتي لا يرجون نكاحاً فليس عليهن جناح أن يضعن ثيابهن غير متبرجات بزينة وأن يستعففن خير لهن)[النور:60] ،
“And women upon whom post-menopausal age has settled who do not desire marriage – there is no blame upon them for putting aside their outer garments [not displaying adornment]. But to modestly refrain [from that] is better for them.” (Surah An-Nur: 60).
فدل الترخيص للقواعد من النساء وهن الكبيرات اللاتي لا يشتهين بوضع ثيابهن ، والمقصود به ترك الحجاب ، بدليل قوله بعد ذلك:
The concession given to elderly women—those who no longer have the desire for marriage—to put aside their outer garments refers to leaving off the face veil (hijab), as evidenced by the subsequent phrase:
( غير متبرجات بزينة )
“not displaying adornment”,
أي غير متجملات ، فيما رخص لهن بوضع الثياب عنه وهو الوجه ، لأنه موضع الزينة ، دلّ هذا الترخيص للنساء الكبيرات أن غيرهن ، وهن الشواب من النساء مأمورات بالحجاب وستر الوجه ، منهيات عن وضع الثياب ، ثم ختمت الآية بندب النساء العجائز بالاستعفاف ، وهو كمال التستر طلباً للعفاف
meaning without beautifying themselves in what was conceded for them to uncover, which is the face, as it is the place of adornment. This concession for elderly women demonstrates that others—namely young women—are commanded to wear the hijab and cover their faces, and are forbidden from putting aside their garments. The verse then concludes by encouraging elderly women to maintain modesty, which means complete covering in pursuit of chastity:
( وأن يستعففن خير لهن).
“But to modestly refrain [from that] is better for them.”
5- روى الترمذي وغيره من حديث أبي هريرة أن النبي صلى الله عليه وسلم قال :
5) At-Tirmidhi and others narrated from the Hadith of Abu Hurairah that the Prophet (peace and blessings of Allah be upon him) said:
” المرأة عورة فإذا خرجت استشرفها الشيطان “.
“A woman is an ‘awrah; when she goes out, Satan seeks to beautify her.”
وهذا دليل على أن جميع بدن المرأة عورة بالنسبة للنظر .
This is evidence that the entire body of a woman is ‘awrah with respect to sight.
6- وعن ابن عمر أن النبي صلى الله عليه وسلم قال : ”
6) On the authority of Ibn Umar, the Prophet (peace and blessings of Allah be upon him) said:
لا تنتقب المرأة المحرمة ولا تلبس القفازين ” رواه البخاري وغيره .
“A woman in Ihram should not wear a niqab nor should she wear gloves.” (Narrated by Al-Bukhari and others).
قال الإمام أبوبكر بن العربي : وذلك لأن سترها وجهها بالبرقع فرض إلا في الحج ، فإنها ترخي شيئا من خمارها على وجهها غير لاصق به، وتعرض عن الرجال ويعرضون عنها. انتهى من عارضة الأحوذي . وقد قالت أم المؤمنين عائشة رضي الله عنها :
Imam Abu Bakr Ibn al-Arabi said: “This is because covering her face with a burqa is obligatory except during Hajj, where she lowers a part of her headcover over her face without it clinging to it, turning away from men and men turning away from her.” (End quote from ‘Aridhat al-Ahwadhi). Mother of the Believers Aisha (may Allah be pleased with her) said:
كنا إذا مر بنا الركبان – في الحج- سدلت إحدانا الجلباب على وجهها ، فإذا جاوزونا كشفناه .
“When riders passed by us—during Hajj—one of us would lower her jilbab over her face, and when they passed us, we would uncover it.”
إلى غير ذلك من الأدلة : وننصحك بقراءة كتاب ” عودة الحجاب ” للدكتور محمد أحمد إسماعيل ، القسم الثالث من الكتاب ، للوقوف على الأدلة مفصلة والله أعلم .
