شخص عمره 36 عاماً ملتزم بالفروض والنوافل ولكنه لم يبدأ بالصيام إلا عندما كان عمره 20 عاماً .هل يصوم السنوات التي لم يصمها؟
A person aged 36 years maintains the obligatory and sunnah deeds, but he only started fasting when he was 20 years old. Should he make up for the years he did not fast?

الحمد لله، والصلاة والسلام على رسول الله، وعلى آله وصحبه، أما بعد:
Praise be to Allah, and peace and blessings be upon the Messenger of Allah, his family, and his companions. To proceed:
فيجب عليك قضاء كل شهر أفطرته بعد بلوغك سن الاحتلام، كما يجب عليك أن تطعم ثلاثين مسكيناً مع قضاء كل شهر. أما وجوب القضاء فلأنه مازال باقياً في ذمتك، وأما وجوب الإطعام فهو كفارة عن تأخير القضاء عن وقته المحدد له من الشارع وهو الأحد عشر شهراً التي تكون بين رمضان ورمضان.
You must make up (qadha) every month you did not fast after reaching the age of puberty (nocturnal emission). You also must feed thirty poor people along with making up each month. As for the obligation of making up, it is because it remains a debt upon you. As for the obligation of feeding, it is an expiation (kaffarah) for delaying the makeup beyond its specified time in the Sharia, which is the eleven months between one Ramadan and the next.
وهنالك نقطة يجب التنبيه لها وهي أن أي يوم أصبحت فيه عاقداً النية على الصوم، ثم أفسدت فيه صيامك بجماع في نهار رمضان تجب عليك فيه كفارة منتهك الحرمة، وهي عتق رقبة فإن لم تجد فصيام شهرين متتابعين فإن عجزت فإطعام ستين مسكيناً، كما ثبت ذلك فيما رواه البخاري من حديث أبي هريرة رضي الله عنه. فإذا كان فطرك بغير جماع، فقد اختلف أهل العلم: فمنهم من ألزمك بهذه الكفارة ومنهم من لم يلزمك بها.
There is a point that must be noted: if on any day you had intended to fast and then broke your fast by having sexual intercourse during the day in Ramadan, you are obligated to pay the expiation for violating the sanctity (of the month). That is freeing a slave; if not possible, then fasting two consecutive months; and if unable, then feeding sixty poor people, as established in the hadith narrated by Bukhari from Abu Hurairah (may Allah be pleased with him). If your breaking of the fast was other than through intercourse, the people of knowledge have differed: some obligate this expiation upon you, while others do not.
وعلى كل فعليك أن تكثر من التوبة والأعمال الصالحة فقد ارتكبت أمراً عظيماً بتعطيلك ركناً من أركان الإسلام هذه الفترة الطويلة ، فقد قال صلى الله عليه وسلم في الحديث المتفق عليه وهذا لفظ مسلم:
In any case, you should increase your repentance and good deeds, for you have committed a grave matter by neglecting a pillar of Islam for this long period. The Prophet (peace and blessings of Allah be upon him) said in the agreed-upon hadith (and this is the version of Muslim):
“بني الإسلام على خمس، أن يعبد الله ويكفر بما دونه وإقام الصلاة وإيتاء الزكاة، وحج البيت وصوم رمضان”
“Islam is built on five: that Allah be worshipped and what is besides Him be denied, establishing prayer, giving zakat, pilgrimage to the House, and fasting Ramadan.”
ولا يخفى عليك ماذا يعني الركن بالنسبة للبناء. والعلم عند الله تعالى .
It is not hidden from you what a pillar means to a building. And the knowledge (truth) is with Allah the Almighty.
