السؤال:

Question:

١- هل الاكتحال يبطل الصيام بمعنى إذا وضعت المرأة الكحل في نهار الصيام هل يبطل صيامها سواء كان ذلك في الفرض أو التطوع؟ ٢- لا يجوز للمرأة أن تصوم تطوعاً إلا بإذن زوجها فهل إذا سمح الرجل لزوجته بالصيام تطوعاً يكون له أجر؟ جزاكم الله عنا خير الجزاء.

1- Does wearing kohl (eyeliner) invalidate the fast? Meaning, if a woman applies kohl during the day while fasting, is her fast broken, whether it is an obligatory or voluntary fast? 2- It is not permissible for a woman to perform voluntary fasting except with her husband’s permission; if a man allows his wife to fast voluntarily, does he receive a reward? May Allah reward you with the best of rewards.

Answer :

الحمد لله، والصلاة والسلام على رسول الله، وعلى آله وصحبه، أما بعد: فإن مجرد الاكتحال الذي لم يصحبه وجود طعم أو لون للكحل في حلق الصائم لا يبطل الصوم، فرضاً كان أو نفلاً، وهذا محل اتفاق.

Praise be to Allah, and peace and blessings be upon the Messenger of Allah, his family, and his companions. To proceed: The mere application of kohl that is not accompanied by the presence of the taste or color of the kohl in the throat of the fasting person does not invalidate the fast, whether it is obligatory or voluntary, and this is a matter of consensus.

أما إذا وصل طعم أو لون الكحل إلى الحلق، فإن من العلماء من يقول ببطلان الصوم لذلك، لكن الصحيح أنه لا يبطل الصوم، ولا يؤثر عليه، لأنه ليس بأكل ولا شرب، ولا في معناهما، وهذا هو اختيار شيخ الإسلام ابن تيمية وطائفة من المحققين، والله أعلم بالصواب.

As for when the taste or color of the kohl reaches the throat, some scholars say that the fast is invalidated because of that. However, the correct view is that it does not invalidate the fast and has no effect on it, because it is neither eating nor drinking, nor is it in the same sense as them. This is the choice of Sheikh al-Islam Ibn Taymiyyah and a group of verified scholars. And Allah knows best what is correct.

٢/ فمن المعروف أن المرأة لا يحق لها أن تتطوع بصوم وزوجها حاضر إلا بإذنه، لقوله صلى الله عليه وسلم:

2/ It is well known that a woman has no right to perform a voluntary fast while her husband is present except with his permission, based on the saying of the Prophet (peace and blessings of Allah be upon him):

“لا يحل للمرأة أن تصوم وزوجها شاهد إلا بإذنه” متفق عليه، واللفظ للبخاري.

“It is not lawful for a woman to fast while her husband is present except with his permission.” (Agreed upon, and the wording is from Bukhari).

قال الحافظ قوله: إلا بإذنه يعني في غير صيام أيام رمضان، وكذا في غير رمضان من الواجب إذا تضيق الوقت. ا.هـ. وعند الدرامي عن أبي هريرة رضي الله عنه قال: قال رسول الله صلى الله عليه وسلم:

Al-Hafiz said regarding the phrase “except with his permission”: meaning in fasts other than the days of Ramadan, and likewise in obligatory fasts other than Ramadan if the time has become narrow. In the narration of Ad-Darimi from Abu Hurairah (may Allah be pleased with him), he said: The Messenger of Allah (peace and blessings of Allah be upon him) said:

“لا تصوم المرأة يوماً تطوعاً في غير رمضان وزوجها شاهد إلا بإذنه”.

“A woman should not fast a day voluntarily outside of Ramadan while her husband is present except with his permission.”

وعند الطبراني عن ابن عباس قال: قال رسول الله صلى الله عليه وسلم:

In the narration of At-Tabarani from Ibn Abbas, he said: The Messenger of Allah (peace and blessings of Allah be upon him) said:

“من حق الزوج على زوجته أن لا تصوم تطوعاً إلا بإذنه، فإن فعلت لم يقبل منها”.

“It is among the rights of the husband over his wife that she should not fast voluntarily except with his permission; if she does so, it will not be accepted from her.”

وإنما منع صوم المرأة تطوعاً بغير إذن زوجها الحاضر لتأكد حقه عليها وأولويته على تطوعها بالصيام، فإذا ما تنازل عن حقه وسمح لها بالقيام بهذه الطاعة العظيمة بنية إعانتها عليها كان ممتثلاً، لقول الله تعالى:

The prohibition of a woman fasting voluntarily without the permission of her present husband is only due to the strength of his right over her and its priority over her voluntary fasting. Therefore, if he waives his right and allows her to perform this great act of obedience with the intention of assisting her in it, he has complied with the saying of Allah the Almighty:

(وَتَعَاوَنُوا عَلَى الْبِرِّ وَالتَّقْوَى) [المائدة: ٢]

“And cooperate in righteousness and piety.” [Al-Ma’idah: 2]

فيكون له أجر امتثال أمر الله تعالى، وأجر الإعانة على الخير. والله أعلم.

Thus, he receives the reward for complying with the command of Allah the Almighty and the reward for assisting in goodness. And Allah knows best.
