ما هو الحكم الشرعي لمن صام قبل المسلمين بيوم مدعيا أن شهر شعبان لا يتجاوز تسعة وعشرين يوماً، وهذا الشيء منتشر وواقع بين بعض الناس في نجران؟
What is the Sharia ruling for those who fast one day before the Muslims, claiming that the month of Sha’ban does not exceed twenty-nine days, a practice that is widespread and occurring among some people in Najran?

Answer :
الحمد لله، والصلاة والسلام على رسول الله، وعلى آله وصحبه، أما بعد: فقد قدمنا حكم تقدم رمضان بصيام يوم أو يومين على سبيل الاحتياط أنه من رمضان في الفتوى الأخرى هنا :
Praise be to Allah, and peace and blessings be upon the Messenger of Allah, his family, and his companions. To proceed: We have previously explained the ruling on preceding Ramadan by fasting one or two days as a precaution (ihtiyath) as if it were part of Ramadan in another fatwa here:
أما ادعاء أن شهر شعبان لا يزيد على تسعة وعشرين يوماً فهذه دعوى باطلة بنص الأحاديث الصحيحة، ومنها ما رواه البخاري في صحيحه عن ابن عمر رضي الله عنهما، أن رسول الله صلى الله عليه وسلم قال:
As for the claim that the month of Sha’ban does not exceed twenty-nine days, it is a false claim based on the text of authentic hadiths. Among them is what Al-Bukhari narrated in his Sahih from Ibn Umar (may Allah be pleased with them), that the Messenger of Allah (peace and blessings of Allah be upon him) said:
“الشهر تسعة وعشرون ليلة، فلا تصوموا حتى تروه، فإن غم عليكم فأكملوا العدة ثلاثين.”
“The month consists of twenty-nine nights, so do not fast until you see it (the hilal), and if it is obscured by clouds for you, then complete the number as thirty.”
