أنا مصرية مقيمة في قطر، والسؤال هو: هل يجب علي قضاء صوم يوم الأحد 26 أكتوبر والمفترض صيامه حسب رؤيه هلال رمضان فى مصر مع العلم بأنني سوف أسافر لقضاء آخر أيام الشهر الفضيل هناك فى مصر؟

I am an Egyptian woman living in Qatar. My question is: Am I obligated to make up (qadha) the fast of Sunday, October 26th, which was supposed to be fasted according to the sighting of the Ramadan crescent in Egypt, given that I will travel to spend the last days of this holy month there in Egypt?

Answer :

الحمد لله، والصلاة والسلام على رسول الله، وعلى آله وصحبه، أما بعد: فلا يجب عليك قضاء يوم الأحد لأنك كنت مقيمة في قطر ولم يثبت الشهر فيها ذلك اليوم، وإذا انتقلت إلى مصر فحكمك في الإفطار والصيام حكمهم، فتصومين بصيامهم وتفطرين بفطرهم، لقول النبي صلى الله عليه وسلم:

Praise be to Allah, and peace and blessings be upon the Messenger of Allah, his family, and his companions. To proceed: You are not obligated to make up for Sunday because you were residing in Qatar and the month (of Ramadan) had not been established there on that day. When you move to Egypt, the ruling for you regarding breaking the fast and fasting is the same as their ruling (the local residents). You fast according to their fasting and break the fast according to their breaking of it, based on the saying of the Prophet (peace and blessings of Allah be upon him):

“الصوم يوم تصومون، والفطر يوم تفطرون، والأضحى يوم تضحون.” رواه الترمذي

“Fasting is the day you (the people of the land) fast, breaking the fast (Eid al-Fitr) is the day you break it, and Eid al-Adha is the day you sacrifice.” (Narrated by At-Tirmidhi).

ثم قال: وفسر بعض أهل العلم هذا الحديث فقال: إنما معنى هذا أن الصوم والفطر.. مع الجماعة.. فإذا ثبت الشهر في مصر بعد تسعة وعشرين يوماً فعليك قضاء يوم لأنك صمت ثمانية وعشرين يوماً، والشهر لا يقل عن تسعة وعشرين، ولمزيد من الفائدة نرجو الاطلاع على الفتوى الأخرى هنا :

Then he (At-Tirmidhi) said: Some scholars interpreted this hadith by saying: “Indeed, the meaning of this is that fasting and breaking the fast are done with the community (Jama’ah).” Therefore, if the month (of Ramadan) in Egypt is established to have finished after twenty-nine days, you must make up one day because you (in total) only fasted for twenty-eight days, while a month does not consist of fewer than twenty-nine days.
