نحن مسلمون مقيمون في الصين، نعاني من عدم تمكننا معرفة بدء رمضان وانتهائه بشكل صحيح في كل عام، لكون أن ساعتنا تسبق البلدان العربية بحوالي خمس ساعات، فتقرر الجمعيات الإسلامية تأخير الصيام والإفطار يوماً ربما كي لا نصوم ونفطر قبل إخواننا في الحرم المكي الشريف،
We are Muslims residing in China, suffering from our inability to correctly know the beginning and end of Ramadan each year. This is because our time precedes the Arab countries by about five hours, so the Islamic associations decide to delay fasting and breaking the fast by a day, perhaps so that we do not fast or break the fast before our brothers in the Holy Mosque in Makkah.
فكل عام نفطر أول يوم من رمضان كانت السعودية مثلاً قد صامته، ونصوم أول يوم من عيد الفطر عندهم، وهذا ما يؤلم قلوبنا. فما الحل؟ أفتونا، وجزاكم الله عنا كل خير.
Consequently, every year we do not fast the first day of Ramadan that Saudi Arabia (for example) has started fasting, and we fast on the first day of their Eid al-Fitr. This is what pains our hearts. What is the solution? Give us a fatwa, and may Allah reward you with all goodness on our behalf.

الحمد لله، والصلاة والسلام على رسول الله، وعلى آله وصحبه، أما بعد:
All praise is due to Allah, and peace and blessings be upon the Messenger of Allah, his family, and his companions. To proceed:
فالواجب عليكم في هذه المسألة أن تتعاونوا فيما بينكم، وتكوّنوا لجنة شرعية تضم مجموعة من العلماء وأصحاب التجربة والخبرة لتحري رؤية الهلال في بلادكم، حتى لا تقعوا في الحيرة والاضطراب كل عام بخصوص الفطر والصوم،
What is obligatory for you in this matter is to cooperate among yourselves and form a Sharia committee that includes a group of scholars and those with experience and expertise to monitor the sighting of the crescent in your country, so that you do not fall into confusion and disturbance every year regarding breaking the fast and fasting.
ولا بأس بالاستعانة بمسلمين آخرين من إحدى البلدان المجاورة لكم، وفي حالة عدم تمكنكم من معرفة بدء رمضان أو انتهائه يمكنكم الصوم أو الفطر حسب رؤية البلد المجاور،
There is no harm in seeking help from other Muslims in one of the countries neighboring you. In the event that you are unable to know the start or end of Ramadan, you can fast or break the fast according to the sighting of the neighboring country.
وما دمتم في (الصين) وتسبقون (مكة) بحوالي خمس ساعات، فلا يمكن أن تصوموا وتفطروا حسب أهل مكة، بل الواجب عليكم تحري الهلال، فإذا تمكنتم من رؤيته وجب عليكم الصوم أو الفطر بمقتضى الرؤية، ولو لم توافقوا أهل مكة، لأن النبي -صلى الله عليه وسلم- خاطب عموم المسلمين بقوله:
As long as you are in (China) and you precede (Makkah) by about five hours, it is not possible for you to fast and break the fast according to the people of Makkah. Rather, your duty is to investigate the crescent; if you are able to see it, it becomes obligatory for you to fast or break the fast based on the requirement of the sighting, even if you do not coincide with the people of Makkah. This is because the Prophet (peace and blessings of Allah be upon him) addressed the general body of Muslims by saying:
“صوموا لرؤيته، وأفطروا لرؤيته، فإن غمّ عليكم فأكملوا شعبان ثلاثين.” متفق عليه.
“Fast upon seeing it (the crescent) and break the fast upon seeing it. If it is obscured from you, then complete the month of Sha’ban as thirty days.” (Agreed upon).
وعند النسائي بسند صحيح قوله صلى الله عليه وسلم:
And in a report by An-Nasa’i with an authentic chain, he (peace and blessings of Allah be upon him) said:
“الشهر يكون تسعة وعشرين، ويكون ثلاثين، فإذا رأيتموه فصوموا، وإذا رأيتموه فأفطروا، فإن غُمّ عليكم فأكملوا العدة.”
“The month can be twenty-nine days or thirty days. So if you see it (the crescent), then fast, and if you see it, then break the fast. If it is obscured from you, then complete the count.”
وعند مسلم: “فإن غُمّ عليكم فصوموا ثلاثين يومًا.”
And in Muslim: “If it is obscured from you, then fast for thirty days.”
ولا يخفى أنه قد تقرر العمل باختلاف المطالع منذ صدر الإسلام إلى يومنا هذا، وقد أفتى بالعمل بذلك المجمع الفقهي التابع لمنظمة المؤتمر الإسلامي، وغيره.
It is not hidden that the practice of acting upon the difference in moon-sighting locations (ikhtilaf al-mathali’) has been established since the early days of Islam until this day. The Fiqh Academy of the Organization of Islamic Cooperation (OIC) and others have also issued fatwas to act accordingly.
