Question:
Assalamu’alaikum warahmatullahi wabarakatuh. What is the ruling on someone who serves food to non-Muslims during the month of Ramadan before the Maghrib call to prayer? And may Allah reward you with goodness.
Answer:
All praise is due to Allah, and peace and blessings be upon the Messenger of Allah, his family, and his companions. To proceed:
It is not permissible for a Muslim to serve food or drink to a non-Muslim during the daytime in Ramadan, because non-believers are also addressed by the branches of Sharia (furu’ asy-syari’ah) regarding acts of worship according to the most correct opinion, as we have explained in another fatwa here:
Al-Jamal stated in his Hasyiyah on Sharh Manhaj ath-Thullab regarding this issue:
“The fact that he is not prevented from breaking the fast does not negate its prohibition for him, for he is responsible (mukallaf) for the branches of Sharia. Hence, our Sheikh Muhammad bin asy-Shihab ar-Ramli issued a fatwa that it is forbidden for a Muslim to give a drink to a Dhimmi in Ramadan, whether for a fee or otherwise, because that constitutes assistance in his disobedience.” (End).
And Allah knows best.
