رجل واقع امرأته في نهار رمضان ، ولم يكفّر حتى السنة التي بعدها ، ثم عاد فواقعها وهو ينوي التكفير فماذا عليه؟

A man had intercourse with his wife during the day in Ramadan and did not pay the expiation (kaffarah) until the following year, then he did it again (in a subsequent Ramadan) while intending to pay the expiation. What should he do?

الحمد لله، والصلاة والسلام على رسول الله، وعلى آله وصحبه، أما بعد:

All praise is due to Allah, and peace and blessings be upon the Messenger of Allah, his family, and his companions. To proceed:

فإذا كنت واقعت امرأتك في نهار رمضان كما ذكرت فعليك لكل يوم واقعتها فيه كفارة واحدة لذلك اليوم ، وإن جامعتها فيه أكثر من مرة ، فإن تكرر الجماع في أكثر من يوم فلكل يوم كفارة مستقلة، وهذا على ما مضى من السنين ، وهو مذهب جمهور أهل العلم .

If you had intercourse with your wife during the day in Ramadan as you mentioned, you are required to pay one expiation for each day on which you had intercourse, even if you had intercourse more than once on the same day. However, if the intercourse was repeated on different days, there is an independent expiation for each day. This also applies to the years that have passed, and this is the position of the majority of scholars (Jumhur).

والكفارة على الترتيب ، أولا : عتق رقبة . ثانيا : إن لم تستطع ذلك فصيام شهرين متتابعين . ثالثا: إن لم تستطع فإطعام ستين مسكيناً ، وقال الإمام مالك وهو رواية عن أحمد بالتخيير بين هذه الكفارات. 

The expiation follows a specific order (sequential): First, freeing a believing slave. Second, if you are unable to do so, then fasting for two consecutive months. Third, if you are unable to do so, then feeding sixty poor people. Imam Malik—and it is one narration from Ahmad—held the opinion of choice (takhyir) among these types of expiation.
