بسم اللــــه الرحمن الرحيم 

Bismillahir Rahmanir Rahim.

هل يجوز شراء بيت في أمريكا علماً بأن البيوت تباع بالفائدة وهي غالية الثمن ولا أقدر على شراء بيت دفعة واحدة. علماً بأن أجرة البيت في حالة الاستئجار هي نفس القسط الشهري تقريباً في حالة شراء البيت بالفائدة. 

Is it permissible to buy a house in America, knowing that houses are sold with interest (faidah) and they are very expensive such that I cannot afford to buy a house in one lump sum? Considering that the rent for a house is approximately the same as the monthly installment in the case of buying a house with interest.

في هذا منفعة وتيسير على المسلمين ومحافظة على أموالهم. أعلم أن فضيلة الشيخ القرضاوي افتى بجوازها بغير قصد التجارة. فهل تؤيدون هذه الفتوى علماً بأني لا أنوي التجارة ولكن لتوفير أجرة السكن. أفتوني جزاكم الله

In this, there is benefit and ease for Muslims as well as the preservation of their wealth. I know that His Eminence Sheikh al-Qaradawi has issued a fatwa allowing it when it is not for the purpose of trade. Do you support this fatwa, keeping in mind that I do not intend to trade, but rather to save on housing rent? Provide me with a fatwa, may Allah reward you.

Answer:

الحمد لله، والصلاة والسلام على رسول الله، وعلى آله وصحبه، أما بعد: فلا يخفى على المسلم حرمة الربا الغليظة وخطورته على المرء في الدنيا والآخرة. فقد قال الله تعالى:

All praise is due to Allah, and peace and blessings be upon the Messenger of Allah, his family, and his companions. To proceed: It is not hidden from a Muslim the gravity of the prohibition of riba and its danger to a person in this world and the Hereafter. Allah the Almighty has said:

( يا أيها الذين آمنوا اتقوا الله وذروا ما بقي من الربا إن كنتم مؤمنين* فإن لم تفعلوا فأذنوا بحرب من الله ورسوله) [ البقرة:٢٧٨-٢٧٩ ].

“(O you who have believed, fear Allah and give up what remains [due to you] of interest, if you should be believers. And if you do not, then be informed of a war [against you] from Allah and His Messenger.)” [Al-Baqarah: 278-279].

وفي صحيح مسلم عن جابر رضي الله عنه قال: لعن رسول الله صلى الله عليه وسلم آكل الربا، وموكله، وكاتبه، وشاهديه، وقال: “هم سواء “. إلى غير ذلك من النصوص الصريحة الصحيحة في تحريم الربا ولعن كل من له به صلة.

And in Sahih Muslim from Jabir (may Allah be pleased with him), he said: The Messenger of Allah (peace and blessings of Allah be upon him) cursed the one who consumes riba, the one who gives it (the client), its scribe, and its two witnesses, and he said: “They are [all] equal.” This is in addition to other explicit and authentic texts prohibiting riba and cursing everyone connected to it.

ولا شك أن التعامل بالفائدة بمعناها المعروف الآن في عالم المال والأعمال هو عين الربا، وبناء على هذا فإننا ننصحك بأن تبتعد كل البعد عن الربا، والتعامل به بأي وجه من وجوه التعامل ما وجدت لذلك سبيلاً، 

There is no doubt that dealing with interest (faidah) as it is known today in the world of finance and business is the very essence of riba. Based on this, we advise you to distance yourself completely from riba and from dealing with it in any form of transaction as long as you find a way to do so.

وأن تراقب الله تعالى في ذلك وتتقيه فهو سبحانه وتعالى يعلم ما في الصدور ويعلم السر وأخفى، وسيرزقك من حيث لا تحتسب إن صبرت على طاعته وابتغاء مرضاته، وتوكلت عليه، كما وعد سبحانه في قوله:

And be mindful of Allah the Almighty in that regard and fear Him, for He, Glory be to Him, knows what is in the hearts and knows the secret and what is even more hidden. He will provide for you from where you do not expect if you are patient in His obedience and in seeking His pleasure, and put your trust in Him, as He promised in His saying:

( ومن يتق الله يجعله له مخرجاً ويرزقه من حيث لا يحتسب ومن يتوكل على الله فهو حسبه إن الله بالغ أمره قد جعل الله لكل شيء قدراً ) [الطلاق: ٢-٣ ].

“(And whoever fears Allah – He will make for him a way out and will provide for him from where he does not expect. And whoever relies upon Allah – then He is sufficient for him. Indeed, Allah will accomplish His purpose. Allah has already set for everything a [decreed] extent.)” [Ath-Thalaq: 2-3].

وننصحك بمفارقة هذه البلاد التي أنت فيها فإن الإقامة فيها لا تجوز للمسلم إلا للضرورة التي لا تدفع إلا بها. وقد تقدم بيان ذلك في الفتاوى التالية هنا.

We also advise you to leave the land you are currently in, as residing there is not permissible for a Muslim except in cases of necessity that cannot be met otherwise. The explanation for this has been previously provided in the following fatwas here:
