السلام عليكم ورحمة الله وبركاته سمعنا أنه يجب علينا قضاء يوم في رمضان، هل هذا صحيح؟

Assalamu’alaikum warahmatullahi wabarakatuh. We heard that we are required to make up (qadha) a day of Ramadan, is this true?

Answer:

الحمد لله، والصلاة والسلام على رسول الله، وعلى آله وصحبه، أما بعد:

All praise is due to Allah, and peace and blessings be upon the Messenger of Allah, his family, and his companions. To proceed:

فإذا كنتم قد صمتم في بلدكم رمضان في بلاد تتفقون أنتم وأهلها في مطلع واحد وكان ما صمتم بناء على رؤيتكم أو رؤية غيركم من المسلمين تسعة وعشرين يوما أو ثلاثين يوما، فلا يجب عليكم قضاء شيء من رمضان، فقد قال صلى الله عليه وسلم:

If you fasted Ramadan in your country, in lands where you and its people agree on a single rising point of the moon (mathla’), and your fasting was based on your sighting or the sighting of other Muslims for twenty-nine or thirty days, then you are not required to make up anything from Ramadan. The Prophet (peace and blessings of Allah be upon him) said:

“الصوم يوم تصومون والفطر يوم تفطرون والأضحى يوم تضحون.” رواه الترمذي وصححه الألباني

“The fast is on the day you fast, the breaking of the fast (Eid al-Fitr) is on the day you break the fast, and the sacrifice (Eid al-Adha) is on the day you sacrifice.” (Narrated by At-Tirmidhi and authenticated by Al-Albani).

قال الترمذي: وفسر بعض أهل العلم الحديث فقال: إنما معنى هذا أن الصوم والفطر مع الجماعة وعظم الناس.

At-Tirmidzi said: Some scholars interpreted this hadith by saying: “The meaning of this is that fasting and breaking the fast are to be done with the congregation and the majority of the people.”

وقال الخطابي في معنى الحديث: إ

Al-Khaththabi said regarding the meaning of the hadith:

ن الخطأ مرفوع عن الناس فيما كان سبيله الاجتهاد، فلو أن قوما اجتهدوا فلم يروا الهلال إلا بعد ثلاثين فلم يفطروا حتى استوفوا العدد، ثم ثبت عندهم أن الشهر كان تسعا وعشرين، فإن صومهم وفطرهم ماضٍ لا شيء عليهم من وزر أو عيب، وكذلك هذا في الحج إذا أخطأوا يوم عرفة، فإنه ليس عليهم إعادته.

“Indeed, error is excused for people in matters where the method is ijtihad (legal reasoning). So, if a group of people exercised ijtihad and did not see the crescent until after thirty days, and thus did not break their fast until they completed that number, and then it was proven to them that the month was actually twenty-nine days, then their fasting and breaking of the fast are valid, and there is no sin or blame upon them. Likewise, this applies to Hajj; if they make a mistake concerning the Day of Arafah, they are not required to repeat it.”

وإذا كنتم قد صمتم أقل من تسعة وعشرين يوما، فيجب عليكم قضاء ما يكمل به رمضان تسعة وعشرين يوما، لأن الشهر لا ينقص عن تسعة وعشرين يوما كما هو معلوم. وراجع للأهمية الفتوى الأخرى هنا

However, if you fasted less than twenty-nine days, you must make up the days to complete Ramadan to twenty-nine days, because a (lunar) month does not decrease below twenty-nine days, as is well known. For further important details, please refer to the other fatwas here:
