موضوع الفقه أفعال المكلفين من العباد على نحوٍ عام وشامل، فهو يتناول علاقات الإنسان مع ربه، ومع نفسه، ومع مجتمعه.

The subject matter of Fiqh is the actions obligated upon individuals (Mukallafs) in a general and comprehensive manner, addressing the relationships between a person and their Lord, themselves, and their society.

ويتناول الأحكام العملية، وما يصدر عن المكلف من أقوال، وأفعال، وعقود وتصرفات. وهي على نوعين:

It covers practical rulings and what is expressed by a Mukallaf in terms of words, actions, contracts, and behaviors. These are divided into two categories:

الأول: أحكام العبادات: من صلاة، وصيام، وحج، ونحوها.

First : Rulings of Worship (Ibadat): such as prayer, fasting, pilgrimage, and the like.

الثاني: أحكام المعاملات: من عقود، وتصرفات، وعقوبات، وجنايات، وضمانات وغيرها مما يقصد به تنظيم علاقات الناس بعضهم مع بعض.

Second : Rulings of Transactions (Muamalat): covering contracts, behaviors, punishments, crimes, guarantees, and other matters aimed at regulating human relationships with each other.

وهذه الأحكام يمكن حصرها فيما يلي:

These rulings can be summarized as follows:

١ – أحكام الأسرة من بدء تكوينها إلى نهايتها. وتشمل: أحكام الزواج، والطلاق، والنسب، والنفقة، والميراث ونحوها.

٢ – أحكام المعاملات المالية (المدنية): وهي المتعلقة بمعاملات الأفراد، ومبادلاتهم من: بيع، وإجارة، وشركة ونحوها.

٣ – الأحكام الجنائية: وهي التي تتعلق بما يصدر عن المكلف من جرائم وتعديات، وما يستحقه عليها من عقوبات.

٤ – أحكام المرافعات والقضاء: وهي المتعلقة بالقضاء في الخصومات، والدعوى، وطرق الإثبات ونحوها.

٥ – الأحكام الدولية: وهي التي تتعلق بتنظيم علاقة الدولة الإسلامية بغيرها من الدول في السلم والحرب، وعلاقة غير المسلمين المواطنين بالدولة. وتشمل الجهاد والمعاهدات.

1. Family rulings: from the formation of a family to its dissolution. This includes rulings on marriage, divorce, lineage, alimony, inheritance, and similar matters.

2. Financial transactions (civil) rulings: related to the transactions between individuals and their exchanges, such as buying, leasing, partnerships, and the like.
3. Criminal rulings: concerning crimes and offenses committed by a Mukallaf and the appropriate punishments they deserve.
4. Rulings on litigation and judiciary: relating to adjudicating disputes, lawsuits, methods of proof, and similar matters.

5. International rulings: concerning the organization of the relationship between the Islamic state and other states in times of peace and war, as well as the relationship of non-Muslim citizens with the state. This includes rulings on jihad and treaties.
