هل توجد دولة بعد الخلافة العثمانية تعدُّ دولة إسلامية، وما حكم طاعة الحكام في هذه الحالة؟

Is there any state after the fall of the Ottoman Caliphate that can be considered an Islamic state? What is the ruling on obeying rulers in such a case?

Answer

الخلافة أو الإمامة العظمى مترادفتان في الدلالة على معنًى واحدٍ هو القيام بخلافة صاحب الشَّرع في حراسة الدِّين وسياسة الدُّنيا، والحاصل الآن أن منصب الخلافة بمعناها المتمثِّل في شخصٍ واحد قد انقضى،

The Caliphate (Khilafah) or Supreme Leadership (Imamah ‘Uzhma) are two terms that refer to the same meaning, which is fulfilling the role of succeeding the one who established the Shari’ah by safeguarding religion and managing worldly affairs. Currently, the position of the Caliphate in its form represented by a single individual no longer exists.

إلا أنَّ علَّته المتمثلة في الحفاظ على مصالح الناس وسياستهم لا تزال قائمة، وهذا بعينه ما يقوم به رئيس الدولة حديثًا؛ من نحو سياسة الناس وتدبير شؤونهم وتنفيذ الأحكام وتجهيز الجيوش وكسر شوكة المجرمين والأخذ على أيديهم، وإظهار الشعائر.

However, its essence, which lies in maintaining people’s interests and managing their affairs, still remains. This is essentially carried out by modern heads of state, such as in governing the people, managing their affairs, enforcing laws, preparing armies, suppressing the power of criminals, restraining their actions, and upholding religious symbols.

وبما أنَّه قد تقرر شرعًا أن “الميسور لا يسقط بالمعسور”، فعند تعسَّر وجود رجل واحد متمثِّل في شخص الخليفة، ووُجد حكامٌ أعانوا الناس على إقامة الشعائر وساسوهم بما يُحقق مصالحهم، فإنه تجبُ طاعتهم شرعًا ما لم يأمروا الناس بمعصية.

Since it has been established in Shari’ah that “What can be done should not be abandoned due to what cannot be done,” when the presence of a single individual in the form of a Caliph becomes difficult to achieve, and there are rulers who assist people in upholding religious symbols and governing them in a way that ensures their well-being, it becomes obligatory in Shari’ah to obey them as long as they do not command disobedience to Allah.
