والد خطيبتي يعمل في سلطنة عمان وسينهي عمله هناك في الفترة الأخيرة (العشر الأواخر) من رمضان وسيعود إلى الأردن. وقد بدأوا بالصيام هناك بعد الأردن بيوم واحد، السؤال هو ماذا يجب عليه أن يفعل ؟ هل يكمل الصيام ويبدأ العيد معنا أم حسب أيام رمضان في سلطنة عمان، خصوصاً وأنه قد نصوم في الأردن 29 يوماً مما يعني أنه سيصوم 28 يوماً فقط. أفيدونا يرحمكم الله.

My fiancée’s father works in the Sultanate of Oman and will complete his work there during the last period (the last ten days) of Ramadan and return to Jordan. They started fasting there one day after Jordan. The question is, what should he do? Should he complete the fast and start Eid with us, or according to the count of Ramadan days in the Sultanate of Oman? Especially since we in Jordan might fast for 29 days, which would mean he will only have fasted for 28 days. Please advise us, and may Allah have mercy on you.

Answer :

الحمد لله، والصلاة والسلام على رسول الله، وعلى آله وصحبه، أما بعد: فإذا وجد المسلم في بلد، وقد بدأ أهلها صوم رمضان، فالواجب عليه أن يصوم معهم، وحكمه في ذلك حكمهم، لقوله صلى الله عليه وسلم:

Praise be to Allah, and peace and blessings be upon the Messenger of Allah, his family, and his companions. To proceed: If a Muslim is in a country where the people have started fasting Ramadan, it is obligatory for him to fast with them, and the ruling for him in that regard is the same as their ruling, based on the saying of the Prophet (peace and blessings of Allah be upon him):

“الصوم يوم تصومون، والإفطار يوم تفطرون، والأضحى يوم تضحون” رواه أبو داود بإسناد جيد.

“Fasting is the day you (people of the land) fast, breaking the fast (Eid al-Fitr) is the day you break it, and Eid al-Adha is the day you sacrifice.” (Narrated by Abu Dawood with a good chain of narration).

أما لو انتقل إلى بلد آخر، فحكمه حكم البلد الذي انتقل إليه، فيصوم معهم، ويفطر معهم، ويشهد العيد معهم ولا يصوم يوم العيد بحال، فإن تبين أنه صام أقل من تسعة وعشرين يوماً لزمه أن يقضي ما نقص من صيام، لأن الشهر لا ينقص عن تسعة وعشرين يوماً فيقضي ما فاته. والله أعلم.

However, if he moves to another country, his ruling follows the country he has moved to; he fasts with them, breaks the fast with them, and attends the Eid prayer with them, and he must not fast on the day of Eid under any circumstances. If it turns out that he has fasted for fewer than twenty-nine days, he is obligated to make up (qadha) the missing fast, because the (lunar) month does not consist of fewer than twenty-nine days, so he must replace what was missed. And Allah knows best.
