ما هي الكفارة الواجبة على من جامع أهله في نهار رمضان ؟

What is the mandatory expiation (kaffarah) for someone who has intercourse with his wife during the day in Ramadan?

Answer:

الحمد لله والصلاة والسلام على رسول الله وعلى آله وصحبه، أما بعد

Praise be to Allah, and peace and blessings be upon the Messenger of Allah, his family, and his companions. To proceed:

فيجب على من جامع أهله في نهار رمضان أن يعتق رقبة مؤمنة ، فإن لم يقدر على ذلك فليصم شهرين متتابعين ، فان عجز عن ذلك فليطعم ستين مسكيناً، وهذه الكفارة على هذا الترتيب لا ينتقل من خطوة منها إلى الخطوة التي تليها إلا عند العجز عن السابقة، وبهذا الترتيب قال جمهور أهل العلم.

It is mandatory for the one who has intercourse with his wife during the day in Ramadan to free a believing slave. If he is unable to do so, then he must fast for two consecutive months. If he is unable to do that, then he must feed sixty poor people. This expiation follows this specific order (tertib); one cannot move from one step to the next unless they are unable to perform the previous one. This sequence is the view held by the majority of scholars (Jumhur).

وحجة الجمهور: ما رواه الشيخان من حديث أبي هريرة رضي الله عنه أنه قال:

The evidence of the majority of scholars is what was narrated by the two Sheikhs (Bukhari and Muslim) from the hadith of Abu Hurairah (may Allah be pleased with him), who said:

” بينما نحن جلوس عند النبي صلى الله عليه وسلم إذ جاءه رجل فقال: يا رسول الله هلكت، قال :”مالك؟” قال: وقعت على امرأتي وأنا صائم، فقال صلى الله عليه وسلم :”هل تجد رقبة تعتقها ؟ ” قال: لا ، قال:” فهل تستطيع أن تصوم شهرين متتابعين ؟” قال : لا، فقال:” فهل تجد إطعام ستين مسكينا؟”، قال: لا ، قال : فمكث النبي صلى الله عليه وسلم فبينما نحن على ذلك أُتي النبي صلى الله عليه بعرق فيه تمر ـ والعرق المكتل ـ فقال: “أين السائل؟” فقال: أنا، فقال:” خذه فتصدق به”… إلى آخر الحديث، واللفظ للبخاري.

“While we were sitting with the Prophet (peace and blessings of Allah be upon him), a man came to him and said, ‘O Messenger of Allah, I am ruined!’ He asked, ‘What is the matter with you?’ He replied, ‘I had intercourse with my wife while I was fasting.’ So the Messenger of Allah (peace and blessings of Allah be upon him) said: ‘Do you have a slave to set free?’ He said, ‘No.’ He asked, ‘Are you able to fast for two consecutive months?’ He said, ‘No.’ He asked, ‘Do you have the means to feed sixty poor people?’ He said, ‘No.’ The Prophet (peace and blessings of Allah be upon him) remained silent for a while. While we were in that state, a large basket (‘araq) containing dates was brought to the Prophet. He asked, ‘Where is the questioner?’ The man said, ‘I am here.’ He said, ‘Take this and give it in charity’…” (Until the end of the hadith, and the wording belongs to Al-Bukhari).

والواجب على المسلم واللائق به أن يحافظ على صومه ويصونه من كل ما يفسده بل ومن كل ما قد ينقص أجر الصيام وثوابه، وأن يعلم أن حرمة رمضان عظيمة عند الله جل وعلا ، فانتهاكها من أعظم المنكرات. 

It is mandatory for a Muslim and appropriate for him to protect his fast and safeguard it from everything that invalidates it, and even from everything that might decrease the reward and merit of fasting. He should know that the sanctity of Ramadan is great in the sight of Allah, the Mighty and Sublime, and violating it is among the greatest of evils.
